Terms of Service

By creating an account, browsing venues, saving venues, submitting an inquiry or listing a venue on Fêted, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 18 years old to use Fêted. By using the Service, you represent that you are 18 or older. We do not knowingly permit anyone under 18 to create an account or use the Service in any capacity.

Fêted is a discovery platform that helps couples find independent, non-traditional wedding venues and helps venue owners reach couples actively planning a wedding.

Fêted is not a party to any agreement, tour, contract, deposit or booking made between a couple and a venue. All tours, contracts, payments and bookings happen directly between couples and venues, outside of Fêted. We do not process payments for venue bookings, draft contracts on behalf of venues or couples or guarantee that any venue will respond to, honor or fulfill an inquiry.

Venue details, including pricing, capacity, availability and amenities, are provided by venue owners. We make reasonable efforts to verify this information (see Section 8) but do not independently confirm pricing or availability on an ongoing basis and these details may change without notice.

You may create an account as a couple, a venue owner or browse without an account where the Service permits guest use. You agree to provide accurate information, keep your login credentials secure and notify us if you suspect unauthorized access to your account. You are responsible for all activity under your account.

Using Fêted to discover venues, save venues to your shortlist and send availability inquiries is free, for as long as you use the Service. We do not charge couples for these features and do not plan to.

If you list a venue on Fêted, you represent and warrant that:

• You are the owner of the venue or are authorized by the owner to list it and respond to inquiries on its behalf.
• All information you submit, including pricing, capacity, amenities and availability, is accurate to the best of your knowledge and you will update it if it changes materially.
• You own all photos you upload or have written permission from the photo's owner to use them on Fêted and you have the right to grant Fêted the license described in Section 9.
• You will respond to inquiries from couples in good faith and in a reasonably timely manner.

We reserve the right to reject, suspend, edit or remove any listing at our discretion, including for inaccurate information, low-quality or rights-infringing photos, inactive accounts or violation of these Terms.

Couples never pay to use Fêted.

Venue owners pay a recurring subscription fee to maintain an active listing, beginning after any applicable free trial period. Current pricing, trial length and any promotional terms, such as our Founding Venue program, are stated at the time of signup and on our pricing page and govern your specific account. As a general practice: subscriptions are billed monthly, may be canceled at any time with no penalty and no long-term contract and continue until canceled. We do not prorate partial months and do not guarantee refunds for partial billing periods except where required by law.

We may change our pricing for new signups at any time. If we change the price of your existing subscription, we will provide advance notice before the change takes effect.

When a venue listing displays a "Verified" badge, it means that, at the time of our review, Fêted confirmed the venue's business identity, its physical address and that the photos shown were provided by the venue with the right to use them.

Verification is not an endorsement, inspection or guarantee of any kind. It does not mean we have visited the venue, confirmed its current condition, evaluated the quality of its services, confirmed insurance or licensing or guaranteed that information remains accurate after the review date. Verification status reflects a point-in-time check, not an ongoing certification.

"Content" means any text, photos, descriptions, quotes or other material you submit to Fêted. You retain ownership of your Content. By submitting Content, you grant Fêted a non-exclusive, worldwide, royalty-free license to host, display, reproduce and distribute that Content as part of operating and promoting the Service, for example displaying a venue's photos on its listing page or featuring a listing in marketing materials. This license ends when you remove the Content or close your account, except for copies already made for backup or legal compliance purposes.

You are solely responsible for your Content and confirm that posting it does not violate any third party's rights.

You agree not to:

• List a venue you do not own or are not authorized to represent.
• Upload photos you do not have the right to use.
• Submit false, misleading or fraudulent information.
• Scrape, crawl or harvest data from the Service using automated means without our written permission.
• Harass, impersonate or misrepresent yourself to another user.
• Attempt to circumvent the Service to transact with a venue or couple in a way that violates these Terms.
• Introduce malware or attempt to disrupt the Service.
• Use the Service for any unlawful purpose.

When a couple submits an availability inquiry, we forward that inquiry, including the information the couple provides, to the relevant venue and the venue may reply directly to the couple. Fêted is a messenger, not a participant, in this exchange. We are not responsible for the content, accuracy, timeliness or outcome of any communication, negotiation, tour or agreement that follows an inquiry. Disputes between a couple and a venue are between those parties.

The Fêted name, logo, design and the Service's underlying software are owned by us or our licensors and protected by intellectual property law. Nothing in these Terms grants you rights to our trademarks or branding except as necessary to use the Service as intended, for example a venue owner sharing their own public Fêted listing link.

The Service relies on third-party providers, including website hosting (Lovable), database and accounts (Supabase), email delivery (Resend), fonts (Google Fonts) and, only if you allow it, product analytics (PostHog). Your use of the Service is also subject to the practices of those providers as described in our Privacy Policy. We are not responsible for the availability or practices of third-party websites or services we link to, including individual venues' own websites or social media pages.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY VENUE INFORMATION IS ACCURATE, COMPLETE, OR CURRENT. WE DO NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF ANY VENUE OR ANY SERVICES A VENUE PROVIDES.

TO THE FULLEST EXTENT PERMITTED BY LAW, FÊTED AND ITS FOUNDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, ANY VENUE YOU DISCOVERED THROUGH THE SERVICE, OR ANY DEALING BETWEEN A COUPLE AND A VENUE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations on liability, so some of the above may not apply to you.

You agree to indemnify and hold Fêted harmless from any claim, loss or expense, including reasonable attorneys' fees, arising from your Content, your violation of these Terms or your dealings with another user of the Service.

You may stop using the Service or close your account at any time. We may suspend or terminate your access if you violate these Terms, if we discontinue the Service or at our discretion with notice where reasonably practicable. Sections that by their nature should survive termination, including Sections 9, 11, 14, 15, 16 and 18, will survive.

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Before filing a claim, you agree to contact us first at the email address below so we can try to resolve the issue informally. If we can't resolve it within 30 days, any dispute will be resolved in the state or federal courts located in Illinois and you consent to jurisdiction there, except that either party may bring an individual claim in small claims court.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as an in-app notice or email. Continued use of the Service after changes take effect means you accept the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and Fêted regarding the Service.
